Are you “required” to eFile?
The answer for large businesses is, perhaps.
Section 6011(e)(2)(A) of the Internal Revenue Code requires that any person, corporation, partnership, estate or trust filing 250 or more information returns must file certain returns electronically.
Those “certain returns” include the 1098, 1099-INT, 1099-DIV, 3921, 3922, 5498, 5498-ESA, W-2 and other forms. (See IRS tax topics, Topic No. 801 “Who Must File Information Returns Electronically” for more details.)
Nearly 195.2 million returns and other forms were filed electronically last year. That’s 81.3% of all filings in 2020, an increase of 5.7 percent from 2019.
Small companies—the future looks form-free
In fact, the IRS has long proposed lowering the eFile threshold gradually over several years to 10 employees. The current proposed timetable would:
drop the threshold next year to 100 employees for 2023
drop the threshold again to 10 employees in 2024
